Assalamu 'Alaykum wa Rahmatullahi wa BarakatuhuAn apostate is someone who is a traitor ...., in religion he or she is described as a renegade as they turn their back on their mother religion for another. Apostasy is considered haram and therefore not allowed in Islam, and the penalty is severe from the time of the Beloved Prophet (Salla Allahu ta'ala 'alayhi wa Sallam). Only where Muslim countries apply Shariah law can they face the death penalty if the judiciary sanction it.
In Afghanistan a muslim man Abdul Rahman who converted to christianity where Shariah law is in operation is set to be freed. Under the interpretation of Islamic Sharia law on which Afghanistan's constitution is based, Mr Rahman faces the death penalty unless he reconverts to Islam. "The Prophet Muhammad (Salla Allahu ta'ala 'alayhi wa Sallam) has said several times that those who convert from Islam should be killed if they refuse to come back," says Ansarullah Mawlafizada, the trial judge. "Islam is a religion of peace, tolerance, kindness and integrity. That is why we have told him if he regrets what he did, then we will forgive him," he told the BBC News website. Afghan convert set to be freed Abdul Rahman converted to Christianity 16 years ago An Afghan man charged with converting to Christianity is set to be released from jail while his case is reviewed. Abdul Rahman's case has been handed back to the attorney-general because of gaps in the evidence, an official said. Speaking on condition of anonymity, the official said that while the attorney-general looked at the papers, Mr Rahman did not need to be detained. Mr Rahman, a Christian for 16 years, was charged with rejecting Islam and potentially faced the death penalty. Afghanistan's legal system is built on Islamic Sharia law, and Mr Rahman could have faced execution if he had refused to renounce Christianity. Karzai concerned The Afghan government has come under increasing pressure over the case, says the BBC's Sanjoy Majumder in Kabul. Key international backers of President Hamid Karzai have called for Mr Rahman's release, while Muslim conservatives in Afghanistan are in favour of his detention. Mr Karzai has personally intervened in the case and several top level meetings have been held over the past two days to resolve the issue. Details of his imminent release are being kept secret, as feelings in Kabul have run high over the case. 'Mental issues' Earlier, Mr Rahman's family asked the court to dismiss the case against him, saying he suffered from mental illness. Supreme Court Judge Ansarullah Mawlavizada told the BBC there was considerable doubt that Mr Rahman was fit to stand trial. According to Judge Mawlavizada, Mr Rahman appeared "disturbed". He said the accused man's relatives had told the authorities he was insane and that they claimed Mr Rahman had said he heard strange voices in his head. The judge also said it was not clear if the accused was really an Afghan or a citizen of another country. I dont think there can be a greater crime, Islam is the most compasionate and most tolerant but if shariah is implemented then if should expect the consequences.

Heres something i found online ..
Let also look at Noble Verse 5:54 "O ye who believe! If any from among you turn back from his faith, soon will Allah produce a people whom He (Allah) will love as they will love Him lowly with the believers, Mighty against the rejecters, fighting in the way of Allah, and never afraid of the reproachers of such as find fault. That is the Grace of Allah which He will bestow on whom He (Allah) pleaseth. And Allah encompasseth all, and He knoweth all things."
Here in this Holy Verse we see again Allah Almighty strengthening the faith of the Muslims in Islam by assuring them that whenever they see Muslims leaving Islam they will also see those who join Islam with strong faith and love to Allah Almighty.
"As most men are rebellious." (5:49), it is inevitable that there should be apostates even from such a religion of reason and common-sense as Islam. In Verse 5:54 above there is a warning to the Muslims that they should not repeat the history of the Jews, and become so self-satisfied or arrogant as to depart from the spirit of Allah's teaching. If they do, the loss will be their own. Allah's bounty is not confined to one group or section of humanity. He can always raise up people who will follow the true spirit of Islam.

I agree100% we can not be judge and jury. After all he might convert back to Islam if Allah (Subhanahu wa Ta'ala)chooses to show him the light again.

I voted no as well, because like others i feel only Allah ta'ala's punish will count. But that doesnt mean we should feel sorry for him, i would disown the person that did this and drive him out of the community but would not be party to sentence him to the death penalty.

I voted no simply because a lot of the references , verses and hadiths were constructed at a time when Islam was establishing itself. it took 23 years for the Prophet (Salla Allahu ta'ala 'alayhi wa Sallam) to compile the Quran sharif.

The afghanis cant have it both ways they must decide to either apply shariah or dont. If they follow shariah strictly then they mustnt bow to outside pressure from the likes of the vatican, all this does is make a mockery of Islam and its laws of fiqh.

i voted on the basis that the mens mental health should taken into full consideration. This Afghan are am unruly bunch who see who get a "buzz" out of executions.........even though the militant taliban have been removed, things still don't change

Every life is precious, even the life of a sinner. Only Allah (Subhanahu wa Ta'ala) knows the real reason why this man became a kafir.
But there is still a distinct possibility (as has been said already) that this man could become a muslim again, if only he now realises the compassion and mercy of Islam has actually just saved his life from the death penalty for his apostasy.

Though I voted for his death, having read the full thread I reckon its safe to not kill him especially if he is disturbed as his defence team suggest.
Besides, the acceptance of faith from new converts will send a psychological message of shame to those who leave Islam. Unfortanately the nafs is too powerful for some people that they even reject faith. Sorrowful circumstances.
I bore witness to a person converting to Islam and it only strengthened my own stance as a Muslim in particular as a mureed of Ghazi e Millat.
Our Imam on this website, Molana Waseem, did the initiation to welcome him to Islam. Us as the brothers then took him under our wing and slowly but surely got his salaah perfected as well as other regular things that a muslim does.
Seeing things like this is pleasing to the heart, people converting to Islam and especially witnessing and helping the new convert settle.
Although this case in Afghanistan is an issue that has mental integrity in question, therefore may not even make the legal books, it should serve a purpose to perhaps wake the ummat up from slumberland.

Unless the full facts and truths are revealed theres nothing really to go on except heresay. I would think george bush will probably gather forces ready should the death penalty be given.
Ive heard also that secretary of state condoleeza rice is visiting Blackburn. She would probably rub salt in the wound if she gets here

Here is the balanced and correct view by 'Abdurrahmani'l-Djaziri
The legal basis of Islam is the Sharia, Islamic law, that controls and orders all areas of life. It is not a moral law for the sensitising of conscience but is a penal law, requiring the punishment of violators through an instrument of the state. Islam demands a religious state as an executor to enforce the law.
A Muslim is not free to believe or do what he wishes. He is under Islamic law, which was derived and assimilated from the Qur´an, the example of Muhammad (sunna), the final analogy (qijas) and consensus (idjmaa).
Islam describes Muslims as worshippers and slaves of Allah (ibaad Allah). They have submitted themselves to him and are therefore his possession. The word Islam means, "surrender, devotion and submission".
Whoever falls away from faith in Islam commits -- from an Islamic perspective -- an unforgivable sin. He takes himself away from Allah, his owner -- which is theft -- and weakens the Islamic state, an action branded as revolt or insurrection. He who falls away from Islam must, according to the Sharia, be prosecuted, taken into custody by force, and called on to repent. If necessary, his return is to be "helped" along with torture. He who does not embrace Islam again has, according to the Sharia, forfeited his life and is to be put to death by the state. According to the daily paper, Al Alam, King Hassan II of Morocco, who is also the imam of his country, presented the following state of affairs before a human rights commission on May 15, 1990:
"If a Muslim says, 'I have embraced another religion instead of Islam,' he -- before he is called to repentance -- will be brought before a group of medical specialists, so that they can examine him to see if he is still in his right mind.
After he has then been called to repentance, but decides to hold fast to the testimony of another religion not coming from Allah -- that is, not Islam -- he will be judged."
