Salam Imam sahb,
If one says tallaq to your partner in the heat of the moment during an argument with no witnessess, is the marriage according to shariah still permissable ?
The husband and wife are still together and wish to continue as man and wife despite what has been said.

Wa'laykum-as-Salaam,
According to the shar'iyyah, a talaq constitutes when it is said three times with the intention of divorcing ones wife. A single talaq, may not suffice, as this may only be used in seperation, so there has to be three.
The Qur'an al karim says: 'at-talaaqu marrataan'. 'Divorce is twice'. But then it carries on to say: 'fa imsaakum bi ma'rufin aw tasrihim bi ihsaan'. 'then it is to retain with good or to release with kindness'.
So in total it is three before any form of divorce or separation is considered. However, the talaaq should not in any way be used as a threat or slander because out of all the permissable acts, this one is the one which disliked the most by Allah Almighty. So may Allah keep us all in control of ourselves and know what is right from wrong, and keep us held firm on the Sunnah of His Most Beloved Messenger (peace be upon Him).
