Assalamu 'alaykum,
It it Waajib to perform the Fard Salah in their due times. If one does not do so, without a valid excuse as defined by Shari'ah, which we will explain soon, it will be a major sin. Some such valid excuses relieve the person from the Salah entirely. Whilst other valid excuses do not relieve one from Salah but requires one to perform the missed salah.
The valid Shar'iy excuses which relieve one from Salah totally are:
1. Haa'idah; Menstruating women or during Nifas; After-Birth blood discharge, 2. Loss of senses, unconsciousness for a period which extends and surpasses over five consecutive Salah. [If the loss of one's senses or unconciousness is less than five consecutive Salah then it is Wajib to perform the missed Salah].
However, if one ommits the Fard Salah due to consumption of Alcohol or other intoxicants it is Wajib to perform the Fard Salah whilst in such a state.
Performing the Omitted Salah:
It is Wajib to perform the missed/omitted Fard Salah immediately irrespective of whether it was ommited due to a valid or invalid excuse.
It is unlawfull to delay the performing of the ommited Salah. However, sleep, eating, striving for one's livelihood and the studying of such knowledge for one's livelihood which itself is a Wajib are valid Shar'iy excuses for the delay of Salah. The gravity of the Sin for not performing the due Salah on its appointed time is not redeemed merely by performing the Salah, but also requires sincere repentance.
It is Ja'iz; permissible for one to engage in Nawafil; voluntary (plural of Nafl; voluntary, non-obligatory) Salah before performing the missed Salah. Although, ideally, it is preferred one performs the omitted Salah first and ommit the Nawafil, other than the following Salah:
Sunan Mu'akkadah Forenoon Salah Salah Awwabeen Salah at-Tasbeeh Salah Tahiyyat ul-Masjid
If one misses or ommits Salah whilst on a journey as defined by Shari'ah, and performs the missed Salah on one's return to their permanent place of residence, they will perform only the two Rak'ahs; units as is prescribed for a Musafir; Traveller.
It is essential to maintain the order between the omitted Salah and the current Fard Salah applicable during that particular time. Forexample, it is not permissible to perform the Zuhr Salah untill one performs the omitted Fajr Salah. The Witr Salah has the same ruling as the Fard Salah regarding maintaining the of the order of performance.
The preserving of the order of performance is only required when one has omitted less than six Fard Salah excluding the Witr Salah. One is excused from maintaining the order due to time contraints i.e. if Zuhr Salah is near its ending time and one has already omitted Fajr Salah, then one must perform the Zuhr Salah immediately on its prescribed time and perform the Fajr Salah after the Zuhr Salah.
If one has omitted numerous Fard Salah, May Allah protect all Muslims from such a calamity, such that one cannot remember the precise number of missed Salah, then, in such circumstances one must continually perform successively omitted Salah untill one's heart is content with the total number performed.
When one performs the omitted Salah, one must mention the time of Salah, i.e. Fajr, Zuhr or 'Asr Salah. The Niyyah; intention should be as follows;
"I am performing the first Fajr omitted Salah"
or merely say;
"I am performing the omitted Fajr Salah".
It is not permissible to perform the omitted Salah during the following three times:
When the Sun is rising, At the Sun's zenith, When the Sun is setting.
