Bismillahir Rahmanir Raheem Wa'alaykum 'Assalam wa Rahmatullahi wa BarakatuhuAll Praise be to Allah who is the Lord of the Worlds, and may Endless Blessings be showered upon His Most Beloved, and Final Messenger of Islam, Hadrat Muhammad Mustafa Salla Allahu ta'ala 'alayhi wa 'aalihi SallamJazak'allah for your question. According to the fuqaha' (jurists) of Islam, a Dar-ul-Harb is recognised as: 'That land belonging to those who after rejecting the invitation to Islam, have enmity with Islam, and whose inhabitants show hatred and revolt against Islam, and the Muslims, and a land in which the places of worship of the 'dhimmi' (minorities as non Muslims), and of the Muslims, are not secure.'Any land of the Dar-ul-Islam, which falls into the hands of the non-believers, is also regarded as a Dar-ul-Harb, on condition that instead of Islamic law ( shar'iyyah) being implemented there, there is the implementation of non-Islamic laws. Any land which falls out of the participation or action of the Islamic scholars, ( 'ulama'), is to be made cautious, of being called a Dar-ul Harb, so long as there does not remain a single law, remaining which belongs to the shar'iyyah. A land of polythiesm ( shirk), and hatred ( 'inad), is regarded as a Dar-ul-Harb. A land of the non believers is not regarded as a Dar-ul-Harb, unless and until they do not act in opposition to the Dar-ul-Islam, by refute of the invitation to Islam. This is the definition of a Dar-ul-Harb in simple terms, and the few conditions of when and how a Dar-ul-Harb exists. May Allah the Almighty give us all the tawfiq of understanding issues relating to the question asked. (Amin)Wallahu A'almu BiththawaabM. Waseem Ashrafi
